1. Agreement
By using our website or submitting an application, you agree to these Terms. If you do not agree, please do not use our services. These Terms form a binding agreement between you and Foxwell Consumer Capital LLC, a Florida limited liability company.
2. Our Services
Foxwell Consumer Capital LLC provides consumer financial assistance. We are not a bank, credit union, or mortgage lender. When assistance is approved:
- Funds are disbursed directly to your designated third-party vendor — never to you personally;
- You repay the principal amount plus a flat administrative fee of $139.00 via weekly ACH debit;
- No interest is charged — only the flat $139.00 administrative fee.
3. Eligibility
You must be at least 18 years of age, a U.S. resident, have verifiable income, an active U.S. bank account, and not be in active bankruptcy to qualify for assistance.
4. Application & Approval
Submitting an application does not guarantee approval. All applications are individually reviewed under our underwriting criteria. You will be contacted by a Foxwell representative with a decision.
5. Administrative Fee
A flat administrative fee of $139.00 applies to all approved assistance arrangements. This fee covers processing, underwriting, disbursement coordination, and ACH collection management. It is not interest.
6. ACH Authorization & Repayment
By accepting an offer and signing our agreement, you authorize Foxwell to initiate recurring ACH debits from your bank account on the schedule outlined in your agreement. You may revoke this authorization with at least five (5) business days written notice before the next scheduled debit. Returned transactions may result in fees and may affect your account status.
7. Accuracy of Information
All information provided in your application must be true and accurate. Providing false information may result in denial or cancellation of assistance and may carry legal consequences.
8. Electronic Signatures
By typing your name in our application signature field, you agree it carries the same legal weight as a handwritten signature under the E-SIGN Act and applicable Florida law.
9. Privacy
We handle your information in accordance with our Privacy Policy. We do not sell your personal information.
10. Limitation of Liability
To the extent permitted by law, Foxwell Consumer Capital LLC is not liable for indirect, incidental, or consequential damages arising from use of our services.
11. Governing Law & Compliance
These Terms are governed by the laws of the State of Florida. Disputes are subject to the jurisdiction of courts in Orange County, Florida. Foxwell Consumer Capital LLC operates in compliance with the Electronic Fund Transfer Act (EFTA), applicable Florida consumer protection statutes, and all relevant federal law.
